A Michigan village has reached a $320,000 settlement with a Japanese national named Ryohei Akima who was falsely accused of drunk driving due to a misinterpretation of a breath test by a police officer. Officer Caitlyn Peca wrongly understood Akima’s breath test result of 0.02 as 0.22, which would have put him almost three times over the state’s legal limit for driving. The charges against Akima, who was in the U.S. on a work visa in 2020, were dropped when a blood sample confirmed he wasn’t under the influence. Akima sued in federal court, alleging Peca’s actions violated his constitutional rights, with the case being allowed to proceed a few months before the settlement. Peca is no longer serving as an officer in Fowlerville.
