As part of a federal investigation into the Albuquerque Police Department, one of the 152 dismissed DWI cases involved Moses Hernandez. The case, dating back to 2016, was still active until its dismissal on Friday. Hernandez is serving a sentence in federal prison for shooting at three police officers.
The incident occurred in January 2017, when officers responded to a call of a suspicious individual in the vicinity of Chico and Central. Upon their arrival, they encountered Hernandez, who started shooting at them. The officers returned fire, but no one was injured. Hernandez received an eight-year federal prison sentence for the offense of firearm possession as a felon, but his 2016 DWI charge has since been dismissed.
