In Clarion County Courtroom of Frequent Pleas on Wednesday, October 6, 29-year-old Mitchell David Lowers entered a responsible plea to a primary offense misdemeanor of DUI: Basic Impairment.
Because of the plea settlement, the next fees have been dropped:
– Theft By Illegal Taking-Movable Property, Felony 3
– Unauthorized Use Motor/Different Automobiles, Misdemeanor 2
– No Headlights, Abstract
– Fail to make use of security belt – driver and entrance seat occupant, Abstract
Sentencing for the case is scheduled for November 17 with President Decide Sara J. Seidle-Patton presiding.
Lowers stays free on $10,000 financial bail.
The fees stem from a report of a theft in late April.
Particulars of the case:
In response to a prison grievance, Clarion-based State Police have been dispatched to Bashline Street in Beaver Township, Clarion County, round 12:14 a.m. on Sunday, April 25, for a report of theft of a car.
A recognized sufferer reported she noticed a person enter her husband’s Ford F-250 truck that was parked of their driveway and again it out of the driveway. The car then allegedly traveled south on Canoe Ripple Street and pulled right into a enterprise parking zone and stopped, the grievance states.
Police arrived on the scene a short while later and located a person asleep within the driver’s seat of the truck and not using a seat belt on.
The person seemed to be extremely intoxicated, the grievance notes.
He was subsequently positioned below arrest and positively recognized as Mitchell David Lowers, based on the grievance.
Lowers was then transported to the Clarion Hospital for a chemical blood draw.
Lowers was arraigned in entrance of Magisterial District Decide Jarah Lee Heeter at 3:00 a.m. on Sunday, April 25.
